I am General Counsel for ProTechnics International, Inc. and am submitting the enclosed executed and notarized affidavit in connection. with the request of your Commission for the publication of proprietary and confidential information of my client; and in connection with a spill which took place at the University of Virginia Reactor Facility back in 1992, and which was reported to you by that institution on September l 11, 1992.

STATE OF TEXAS I COUNTY OF HARRIS BEFORE ME, the undersigned Notary Public, duly qualified and commissioned for the State and County aforesaid, did personally come and appear John T. Hampton III, personally known to me, who, upon being duly sworn, did depose that he j is the General Manager of ProTechnics International, Inc.  !

("ProTechnics"), sometimes doing business as Spectratek l Services; that affiant is informed that during 1992 the l University of Virginia Reactor Facility ("UVRC") found it i necessary to make a report to the U.S. Nuclear Regulatory l Commission ("NRC") in connection with a spill of solid material in the reactor pool of the UVRC. Affiant further deposed that, in order to describe clearly the event and its i minor significance, information about the solid material and its originator was submitted to the NRC. Affiant further stated to me, Notary, that ProTechnics is the owner of the

! material involved in the event, that such material and i information provided with it to the UVRC is strictly l

confidential and proprietary information of ProTechnics, and l the UVRC was so informed; and such materials and information l constitute trade secrets of ProTechnics. The confidentiality and proprietary information statement was provided to the NRC in the special report of UVRC dated September 11, 1992. The information provided by ProTechnics to the UVRC was so provided on a strictly confidential basis, with the understanding that such would not be publicly revealed.

Affiant further stated that the critical portion of the information which ProTechnics is trying to protect is not generally available through public sources, and that the value to ProTechnics of the amount of effort, money, and time expended to develop the information and technology makes it important to protect the same. Affiant stated that the estimate of monies spent in developing the information and technology in question is approximately $150,000.00 to date.

It would be extremely difficult for others to duplicate the information and technology sought to be protected hereunder, l since they are held in confidence by ProTechnics, and

represent the types of information and technology that are I customarily held in confidence in the industry.
