NRC INSPECTION REPORT N0. 50 62/96 03

Dear Dr. Mulder:

Thank you for your response of February 17, 1997, to the exercise weakness discussed in NRC Inspection Report No. 50 62/96 03. We have evaluated your response and with one exception found it acceptable. The exception was the basis for the incident upgrade from a NOVE to an Alert.

In your response, you indicated that "the ED upgraded the NOUE to an Alert because there were two instances corresponding to a NOVE."

In accordance with the emergency planning standards for research reactors, each emergency classification is based on a specific emergency action level as having been met and/or exceeded. The combination of two competing sets of conditions at the NOUE level, as described in your response, did not meet the criteria for an Alert in your Emergency Plan or Emergency Plan Implementing Procedures. However, the combination of competing conditions at the NOUE and Alert level would in order of increasing severity result in the declaration of an Alert.

If your understanding of this matter is different from the aforementioned statements, please advise this office immediately. We will examine the implementation of your corrective actions during a future inspection.

An error was noted in the date of your letter regarding the calendar year.

The letter was dated February 17, 1996 rather than 1997.

Please correct your file copy to reflect February 17, 1997.
