DECOMMISSIONING OF THE UNIVERSITY OF VIRGINIA RESEARCH REACTOR

Dear Dr. Low:

This is to acknowledge your letter of June 22,1998, informing the Nuclear Regulatory Commission of the University of Virginia's decision to cease operations at the University of Virginia Research Reactor (UVAR) by July 1,1998, and begin the process to decontaminate and decommission the facility.

The regulations in Part 50, Section 50.82(b) of Title 10 of the Code of Federal Regulations 1 (10 CFR 50.82(b)] govern the decommissioning process for non-power reactors. The University should make application for license termination within 2 years following the date of permanent cessation of operations. The application for termination must be accompanied .

by or preceoed by a proposed decommissioning plan. The plan must include (1) the choice  !

of the alternative for decommissioning with a description of activities involved, (2) a l description of the controls and limits on procedures and equipment to protect occupational l and public health and safety, (3) a description of the planned final radiation survay, (4) an update of the cost estimate of decommissioning and the plan for assuring the availability of adequate funds for completion of decommissioning, and (5) a description of technical specifications, quality assurance provisions and security plan provisions in place during decommissioning. The choice of the alternative for decommissioning is acceptable if it j provides for completion of decommissioning without significant delay. Consideration will be g given to an alternative that delays the completion of decommissiontag only when nocessary to protect public health and safety.

The Commission will approve the decommissioning plan if the plan demonstrates that decommissioning will be peiformed in accordance with the regulations and will not be iniraical to the common defense and security or to the health and safety of the public. The Commission will terminate the reactor license if it determines that the decommissioning has been pp.*ormed in accordance with the approved decommissioning plan and the termination

( survey and associated documentation demonstrates that the fccility and site are suitable for release in accordance with the regulations.
