Inspection No. 70-371/85-05 This refers-to an inspection conducted by a representative of the South Caro-

-lina, Department of Health >and Environmental Control on February 26, 1985 of a shipment of radioactive waste from the Uncasville facility. The shipment was inspected upon its arrival at the Chem-Nuclear Systems, Ir.c., burial site at Barnwell, South Carolina. A copy of the inspection report is attached to the NRC Region.I Inspection Report enclosed with this letter.

The inspection indicated that one drum was found to have had a hole in the bottom and some of its contents had leaked out onto the bed of the trailer.

Details are provided in enclosure Appendix A. On February 28, 1985 the State of South Carolina assessed a civil penalty of One Thousand Dollars for this violation, and required the submittal of evidence that adequate measures had be'en implemented to assure compliance with the state and federal regulations.

In addition to this violation you had another violation of the transportation regulations on October 31, 1984, and we are concerned about the implementation of your management control systems that permitted these violations to occur.

Consequently, in your reply, you should describe in particular, those actions taken.or planned to improve the effectiveness of your management control systems.

You are also required to address the specific violation on February 26, 1985 in accordance with enclosure Appendix A.

In view of the circumstances surrounding this matter, we have_ exercised our

' discretion under the NRC Enforcement Policy, and have chosen to issue at this time the enclosed Notice of Violation. After reviewing your response to this Notice of Violation and your proposed corrective actions, the NRC will deter-e mine whether further NRC enforcement action is necessary in order to ensure compliance with NRC regulatory requirements.
