Dear Mr. Andrews:
We have completed our review of your Part 74 Fundamental Nuclear Material Control Plan (FNMCP), Revision 2 (dated June 16,1989), which you submitted by your cover letter also dated June 16, 1989. The June 16, 1989 submittal represents appropriate modifications to your original documents dated December 22, 1987 and July 22, 1988. The FNMCP dated June 16, 1989 is a result of NRC review comments discussed on several different occasions between NRC and UNC Naval Products SSNM material contrcl and accounting personnel both at NRC headquarters and at your facility We have determined that the FNMCP dated June 16, 1989 is acceptable.
Pursuant to 10 CFR 74.51(c)(2), you have 90 days from the date of this letter to implement your approved FNMCP. Until such time, you shall follow your currently approved 10 CFR Part 70 FNMCP and the corresponding Safeguards Amendment, SG-1.
Since your MC&A regulatory base is changing from 10 CFR 70.51, 70.57 and 70.58 to 10 CFR 74.51, 74.53, 74.55, 74.57 and 74.59, it becomes necessary to revise and reissue the MC&A portion of your SG-1 Safeguards Amendment. The revised amendment, designated as SG-2, will become effective upon implementation of your Part 74 FNMC Plan. The license conditions in SG-2 have been discussed with Mr. Tom Collopy of your staff and were mutually agreed upon.
It must be noted that the SSNM material control and accounting operations conducted in MBA-8 (Unit-3, L Building) are limited to those Phase I activities described in UNC's letter with attachments dated February 22, 1989 and as approved by our letter dated March 14, 1989. All other subsequent material control and accounting SSNM activities in Unit-3, L Building must be approved by the NRC prior to start-up.
