In response to your letter of September 10, 1990, we have reviewed ~your request forrelieffrom10CFR73.46(h)(3). This provision relates to requirements for a tactical response team.

In considering this request, we note that SSNM remaining onsite after i

l January 1991 will still include man-portable, divertible items, and that the amount of SSNM will exceed a formula quantity. Accordingly, there remains a need to adequately protect against the design basis threat.

No technical basis was presented in your September 10. 1990, letter which would justify an exemption from the requirements of 10 CFR 73.46(h)(3). The removal of all unencapsulated material is not in itself justification for a

abandoning the Tactical Response Team (TRT).

In light of the above, we have no basis for approving your request at this time.

If you would like us to consider this matter further, please provide information describing how adequate protection would be maintained in the absence of the TRT.
