Dear Mr. G1gliotti:
This letter is a follow-up to your June 10, 1988 telephone conversation with Mr. Charles E. Gaskin regarding the preferred method for searching hand-carried packages prict to their entry into the protected area.
As you know, 10 CFR 73.46(a) is a performance oriented rule.
Please note that it specifically states that the performance capability requirements of Section 73.45 shall include, but are not necessarily limited to, the measures specified ir, ;:aragraphs (b) through (h), and that additional measures may be deemed necessary to meet the general performance objectives and requirements of Section 73.20.
Direct observation or "hands on" searches have been deemed inadequate for use as a routine method of meeting the performance level of the regulation in conducting package searches.
Knowledgeable adversaries are capable of circum-i venting methods that detect form or function by disguising contraband materials into innocuous objects. Accordingly, the acceptabl:: manner to meet those performance objectives is to use equipment to search hand-carried packages.
