Dear Mr. Collopy:
This is in response to your letter dated June 20, 1990 whereby you requested a-three month time delay to complete the review of your nuclear material control system required at least every 12 months by the requirements of 10 CFR 74.59(h)(4).
We have determined that for the reasons put forward in your letter, the requested delay is warranted. We have also determined that the granting of your request will not compromise the general performance objectives of 10 CFR 74.51(a)(1) through (5) and will not adversely affect the comon defense and security nor the public health and safety, and is otherwise in the public interest.
Hence, we are issuing Temporary Condition TC (MC&A)-5.3 to Amendment SG-2 of your License No. SNM-368, effective upon receipt of this letter, to read as follows:
TC(MC&A)-5.3 Notwithstanding the requirements of 10 CFR 74.59(h)(4) to perform independent assessments at least every 12 months that assess the performance of the MC&A system including final documented results, the licensee may have from September 15, 1990 to close-of-business December 14, 1990 to complete the requirements of 10 CFR 74.59(h)(4).
We have determined that certain information contained in your June 20, 1990 will be withheld from public disclosure pursuant to 10 CFR 9.17(a) protected and letter is Confidential-Restricted Data. The letter shall thus be (3).
