Your May 7,1980 Letter with 2-Page Enclosure Regarding NPR Physical Protecticn Recuirements.

Dear Mr. Miller:

We received your subject letter on 19 May 1980 and communicated via telephone with Mr. R. Carter of your office en 30 May 1980 regarding our respcase to your letter.

In view of the let,ter contents and our conversation with Mr. Car-ter, we hereby tender the following:

Paragraph No. 4 of your letter enclosure describes the SIM status of the N. C. State University PUIETAR research reactor facility in that we possess in excess of 10 kilograms SIE of 1cw strategic significance. We have had an approved physical security plan since 11 September 1974 and, after reviewing our plan in connection with the contents of your letter, we find our plan achieves the objectives of 10CFR 73.67(a), (b), (c), (f) and (g) as applicable to our facility. We therefore conclude that the second sentence of Paragraph No. 4 cited earlier, which states in part

"... you must submit a security plan to the NRC by May 18,1980." does not apply to the NCSU PUISTAR facility, in that a suitable plan was sub-mitted and implemented in 197k.

We would appreciate hearing fren your office en this matter should you require additienal response from us.
