MD5262, MD5263, AND MD5264)By letters dated June 28, 2004 and June 25, 2004 (ADAMS Accession Nos.ML041840109 and" ML041840301), TVA submitted license--amendment applications to NRC for the EPU of BFN Unit 1 and BFN Units 2 and 3, respectively.

The proposed amendments would change the operating licenses to increase the maximum authorized core thermal power level of each reactor by approximately 14 percent to 3952 megawatts.

By letter dated July 27, 2007 (ML072130371), TVA submitted Continuum Dynamics, Incorporated (CDI) Report No. 07-011P, "Dynamics of BWR Steam Dryer Components," and requested that it be withheld from public disclosure pursuant to the provisions of 10 CFR 2.390. The NRC staff questioned, as documented by the letter dated November 6, 2008 (ML083100241), whether the CDI report contained information available in public sources and whether public disclosure of the information sought to be withheld is likely to cause substantial harm to the competitive position of the own-er.of the information

-considering the ease or difficulty with which the information could be properly acquired or.duplicated by others. Consequently, CDI has revised the report to better reflect the withholding criteria and provided a modified affidavit that provides additional information indicating why this information should be withheld from public disclosure.

The revision to CDI Report No.07-011 P, "Dynamics of BWR Steam Dryer Components," is provided in Enclosure 1.Note that Enclosure 1 contains information that CDI considers to be proprietary in nature and subsequently, pursuant to 10 CFR 2.390(a)(4), CDI requests that such information be U.S. Nuclear Regulatory Commission Page 2 December 8, 2008 withheld from public disclosure.

Enclosure 3 provides the revised affidavit from CDI supporting this request. Enclosure 2 contains the redacted version of Enclosure 1 with the CDI proprietary material removed, which is suitable for public disclosure.

No new regulatory commitments are .made in this submittal.
