Dear Mr. Denton:

It is requested that Facility Operating License No. NPF-9 for McGuire Unit 1 be amended to authorize transfer of spent fuel between McGuire. Units 1 and 2.

Condition 2.B.(5) of the license currently states:

" Pursuant to the Act and 10 CFR Parts 30, 40 and 70, to possess, but not separate, such byproduct and special nuclear materials as may be produced by the operation of the facility."

The word " facility" as used in the license refers to McGuire Unit 1. This wrding _

prohibits transfer of byproduct and special nuclear material from McGuire Unit 1 i: to Unit 2 and vice versa. It is believed that this restriction is unintentional since there is no justification for segregating the byproduct and special nuclear

[ material produced by the two units. Therefore, we propose that Condition 2.B.(5)

I of License No. NFP-9.be amended to read as follows:

" Pursuant to the Act and 10 CFR Parts 30, 40 and 70, to possess, but not separate, such byproduct and special nuclear materials as may be produced by the operation of McGuire Nuclear Station, Units 1 and 2."

It is also requesi;.ed that the original issuance of the license for McGuire Unit 2 l include this provision.

In addition to the aforementioned revision, it is requested that McGuire Unit 1 License No. NFP-9 be amended to incorporate the McGuire Unit 2 Appendix A, Technical l Specifications, into the McGuire Unit I license to supercede the existing Technical l Specifications. The Technical Specifications for McGuire Unit 2 have been developed so that they can be incorporated "as is" for McGuire Unit 1. -i Harold R. Denton February 18, 1983 Page 2 of the Unit 2 license except that systems and components may be considered operable based upon the requirements in the current McGuire Unit 1 Technical Specifications until no later than:

(1) 31 days after the effective date, foi systems and components having new surveillance requirements which can be performed during reactor qperation, or (2) startup after the first refueling, for systems and components having new sarveillance requirements which cannot be performed during reactor operation.

This provision will allow sufficient time to successfully comply with all new surveillance requirements which are not required in the current Technical Specifications while not requiring a reactor shutdown solely to perform the n a surveillance.

This proposed amendment has been reviewed and determined not to involve any adverse safety or environmental impacts. Pursuant to 10 CFR 170.22, a check for $1,200 is enclosed.
