Proposed Technical Specification (TS) Amendment j TS 3.7.9 - Control Room Area Ventilation System Pursuant to 10CFR50.90, 10CFR50.91, and 10CFR50.4, this letter submits a one time emergency license amendment request (LAR) for the McGuire Nuclear Station Facility Operating License (FOL) and Technical Specifications (TS). The changes proposed by DEC in j this LAR will facilitate the one time addition of Condition "G" and an administrative controls note to TS 3.7.9, Control Room Area Ventilation System (CRAVS). This amendment is applicable to Facility Operating Licenses NPF-9 and NPF-17 for the McGuire Nuclear Station. It will be effective on issuance and expire upon the resolution of the CRAVS Train "B" equipment problems which precipitated this LAR.

The CRAVS system consists of "A" and "B" Trains which are designed to maintain an acceptable control room environment following a Design Basis Accident (DBA). The system accomplishes this function by filtering the supply air to the control room and '

by maintaining the control room at a positive pressure with k respect to adjacent rooms. The CRAVS system recently experienced an equipment failure which rendered the "B" Train inoperable. [

Consequently, the CRAVS system is in a 7 day LCO in accordance with the requirements of Condition "A" of TS 3.7.9. In order to facilitate repairs, the control room boundary will be breeched.

This inoperable boundary will render both CRAVS trains inoperable since they will be incapable of maintaining a positive pressure 3 in the control room, fo \

Currently, Condition "E" of TS 3,7.9 requires immediate entry l

into TS 3.0.3 when both trains of CRAVS are inoperable. TS 3.0.3 requires entry into a MODE for which TS 3.7.9 is not applicable l

(Mode 5, 6, or No Mode). In lieu of subjecting McGuire Units 1 and 2 to the plant transients which compliance with TS 3.7.9 would entail, this LAR adds a Condition "G" to that TS which 9906140268 990610 PDR ADOCK 05000369 p PDR ,

. is applicable during the repair efforts associated with the CRAVS Train *B" equipment. This condition requires that the control room boundary be returned to an operable status within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> when both CRAVS trains are inoperable due to an inoperable control room boundary. Note that the changes contained in this LAR are consistent with a generic change (TSTF-287 R2) proposed by the industry owners group and is similar to LCO 3.6.16 for the Reactor Building. LCO 3.6.16 allows 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> to restore the Reactor Building envelope-to operable status before requiring an orderly shutdown from operating conditions.

Note that'the CRAVS. equipment failure which precipitated the need for this LAR was a bearing failure on an air handling unit associated with CRAVS Train "B". This failure occurred on June 9, 1999 with no prior indication that the equipment was experiencing problems. As stated previously, failure to implement this LAR in a timely manner would result in the shutdown of McGuire Units 1 and 2. Consequently, the criteria for submittal of an emergency TS change as stated in 10CFR50.91 is satisfied.

Given the determination that this proposed amendment contains no significant hazards considerations, McGuire maintains that precluding an unnecessary plant transient by implementing this emergency one time LAR is in the best interests of the overall health and safety of the public.

Attachment 1 provides marked up pages of the existing McGuire TS 3.7.9 showing the proposed changes. Attachment 2 contains the new McGuire TS 3.7.9 pages. The Description of Proposed Changes and Technical Justification is provided in Attachment 3. Pursuant to 10CFR50.92, Attachment 4 documents the determination that this proposed amendment contains No Significant Hazards  !

Considerations. Pursuant to 10CFR51.22 (c) (9) , Attachment 5 l provides the basis for the categorical exclusion from performing  !

an Environmental Assessment / Impact Statement. Marked up portions l of the McGuire TS 3.7.9 BASES is included in Attachment 6 while  !

the new TS 3.7.9 BASES is contained in Attachment 7. These BASES I changes.are included in order to show proposed changes resulting )

from this LAR and to provide additional information supporting i this LAR. Implementation of this amendment to the McGuire FOL and TSs will not impact the McGuire UFSAR. l In accordance with Duke internal procedures-and the Quality Assurance Program Topical Report, this proposed amendment has been previously reviewed and approved by the respective station's Plant; Operations Review Committee and the Duke Corporate Nuclear j Safety Review Board. This LAR contains no regulatory '

commitments.
