McGuire Nuclear Station, Units 1 and 2 Docket Nos. 50-369 and 50-370 Boron Concentration Limits for Refueling Water Storage Tank and Cold Leg Accumulators Proposed Technical Specification Amendment Request-Dear Sir; Pursuant to 10 CFR 50.4 and 10 CFR 50.90, attached are proposed license amendments to Appendix A, Technical Specifications (TS), of Facility Operating Licenses NPF-9 and NPF-17 for McGuire Nuclear Station Units 1 and 2, respectively.
The proposed amendments would revise the boron concentration limits within the refueling Water Storage Tank (RWST) and within the Cold Leg Accumulators-(CLA) in order to support the safe operation of McGuire Unit 2 Cycle 9 and subsequent cycles.
The revisions to the boron concentration limits in the RWST and CLA are required to offset the additional reactivity needed to meet the energy-requirements of longer fuel cycle lengths, and the increased positive reactivity inserted following a cooldown of a core with a high percentage of Babcock & Wilcock (B&W) MkBW fuel.
McGuire Unit 2 end-of-cycle 8 refueling outage is currently scheduled to begin on July 1, 1993.
This refueling outage is presently scheduled to last 75 days.
As such, the unit is scheduled to enter mode 4 on September 3, 1993.with return to full power operation on September-13,'1993.
NRC approval of the TS amendment request is needed prior to entering mode 4 (September 3, 1993).

the NRC staff be expedited.
A discussion concerning the reason for an expedited review is briefly discussed.within this paragraph.
By a letter dated January 13, 1993, a proposed TS amendment request for both the McGuire and the Catawba Nuclear Station was submitted.
The January 13, 1993 amendment request application would have relocated certain cycle specific parameter limits to the Core Operating Limits Report (COLR).
Approval of the January 13, 1993 submittal would have allowed the McGuire Unit 2 Cycle 9 Reload associated changes to be implemented in accordance with the provisions of 10 CFR 50.59. Recently, members of my staff were advised that the schedule of the NRC staff review of the January 13, 1993 submittal could not support the startup of McGuire Unit 2 Cycle 9, and that a reload-specific TS amendment request should be submitted. contains the marked up TS pages indicating the proposed changes. contains the technical justification for the proposed changes. 'The reload report prepared for McGuire Unit 2 Cycle 9 is provided by.
Pursuant to 10 CFR 50.91, Attachment 4 provides the analysis performed in accordance with the standards contained in 10 CFR 50.92.
Thie analysis concluded that the proposed amendments do not involve a Significant Hazards Consideration.
By copy of this submittal, this amendment request application and No Significant Hazards Consideration Evaluation is being forwarded to the appropriate North Carolina state official.
The proposed TS changes provided by Attachment 1 also include revisions to the Bases of the McGuire TSs.
The Bases changes provided by this application were reviewed in accordance.with the criteria / guidance provided by an NRC letter dated December 30, 1991, in that changes to TS bases maybe made pursuant to the provisions of 10 CFR 50.59.
Based on this review, it is concluded that prior NRC review and approval is not required.
Notwithstanding the fact that prior NRC approval is not required,:the proposed changes to the TS Bases of McGuire have been included with this submittal for NRC review and approval.

The timely resolution of the regulatory issues involved with the relocation of certain cycle specific parameters to the COLR is encouraged.
Please be advised that similar TS changes provided by this letter will also be requested-for McGuire Unit 1 and both Catawba-units in the near future.
NRC approval of the January 13, 1993 submittal will allow future reloads to be implemented in accordance with the provisions of 10 CFR 50.59, otherwise these future reloads will require TS changes for.McGuire Unit 1 and both Catawba units.
As a final note, The technical justification for the TS changes provided by this letter relies on information that has been provided in support of the January.13, 1993 submittal.
As the NRC staff reviews the-amendment request application provided by this letter, the correspondences and information that have been provided in support of the January 13, 1993 submittal should also be referred to by the NRC staff.
The dates of the letters submitted in support of the TS amendment request application to relocate certain cycle specific parameters to the COLR are as follows:
January 13, January 28, February 17, and April 26, 1993.
