Pursuant to 10 CFR 50.90, Duke Energy Corporation is requesting an exigent amendment to the Catawba and McGuire Nuclear Station Facility Operating Licenses and Technical Specifications (TS). This amendment applies to the TS requirements for the ice condenser ice bed. Specifically, the proposed amendment changes that portion of the subject surveillance pertaining to the lower inlet plenum support structures and turning vanes from a 9-month frequency to an 18-month frequency. The subject surveillance cannot be performed on these components during power operation.

This proposed TS amendment impacts the Catawba and McGuire Improved Technical Specifications (ITS) conversion license amendment submittals. The Catawba and McGuire ITS conversion license amendments were submitted to the NRC on May 27, 1997. Accordingly, the necessary revised ITS ,

submittal documentation is also included in this amendment '

U.S. Nuclear Regulatory Commission Page 2 August 14, 1998 Attachments la, lb, Ic, and 1d provide a marked copy of the affected current TS pages for Catawba Units 1 and 2, and McGuire Units 1 and 2, respectively, showing the proposed changes. Attachments 2a, 2b, 2c, and 2d are reprinted pages of the affected current TS pages.

Attachments 3a and 3b provide the revised ITS submittal documentation for Catawba and McGuire, respectively.

Attachment 4 provides a description of the proposed changes and technical justification. Pursuant to 10 CFR 50.92, Attachment 5 documents the determination that the amendment contains No Significant Hazards Considerations. Pursuant to 10 CFR 51. 22 (c) (9) , Attachment 6 provides the basis for the categorical exclusion from performing an Environmental Assessment / Impact Statement.

Implementation of this amendment to the Catawba and McGuire Facility Operating Licenses and TS will not impact the Catawba or McGuire Updated Final Safety Analysis Reports (UFSARs).

Duke is requesting NRC approval of this amendment request on an exigent basis pursuant to the requests for enforcement discretion made on August 12, 1998 for Catawba Unit 2 and McGuire Units 1 and 2 concerning this issue. This exigent I

request is necessary because Catawba and McGuire have determined that the requirements of the subject TS are not being met in their entirety. This exigent request is being made' pursuant to 10 CFR 50.91(a)(6)(vi).

In accordance with Duke administrative procedures and the Quality Assurance Program Topical Report, this proposed amendment has been previously reviewed and approved by the Catawba and McGuire Plant Operations Review Committees and the Duke Corporate Nuclear Safety Review Board.
