Pursuant to 10CFR50.4 and 10CFR50.90, please find attached the  !

proposed license amendments to Appendix A (Technical '

Specification of Facility Operating License NPF-9 and NPF-2 7 for McGuire Nuclear Station Un' 1 and 2) regarding the safety-related 125VDC Vital Inst .antation and Control Power System. The proposed amendments are a one-time only change necessary to allow replacement of the existing 125VDC battery cells with new cells.

McGuire currently has AT&T high specific gravity round cell batteries installed in all four battery banks of the vital 125VDC system. On October 28, 1996, the TS surveillance test of vital battery EVCC failed to meet TS 4.8.2.1.2.e requirements resulting in the shutdown of both McGuire units.

Since then, the operabi2 ity of all vital batteries has been confinned via surveillance testing and both McGuire units returned to service. In order to prevent a recurrence of this situation, the long term plan is to replace all high specific gravity battery cells with conventional low specific gravity cells by the end of 2EOC11. While a battery bank is being I replaced, a temporary battery bank will be installed so that . l the affected vital bus will remain battery-backed during the replacement. Modification plans are in progress on an accelerated schedule with the initial replacement being Vital Battery Bank EVCA targeted for early February, 1997.

Therefore, expedited approval of the proposed amandment is requested by February 1, 1,17'to allow the modifications to proceed. Current plans wi .11 result in replacement of all four vital battery banks by the end of 2EOC11.

Attachment 2 contains the Technical Justification, Attachment 3 contains the No Significant Hazards Statement, Attachment 4 contains.the Environmental Impact Statement, and Attachment 5 contains the April 16, 1991, Duke Power submittal and the July 1, 1991,' ONRR approval for the TS amendment relating to the 1991-92 vital battery replacements. In addition,

, Attachment 1 contains the proposed TS Bases changes submitted for information only. The Bases section for Technical Specifications 3.8.1, 3.8.2, and 3.8.3 will be reviewed and revised as necessary as part of the TS implementation process.

The proposed TS amendmant has been reviewed and approved by the McGuire Plant Operation Review Committee and by the Duke Power Nuclear Safety Review Board.
