Dear Mr. Cunningham:

This letter is in response to the questions raised in your letter of June 5,1980 regarding the current status of the West Valley reprocessing facilities.

1. NFS had previously announced its intention not to renew the Lease for the West Valley site with the New York State Energy Research and Development Authority (the Authority) . Accordingly, the Lease will expire on December 31, 1980.
2. A possible replacement operator has not yet been identified. The Authority has solicited expressior.2 of interest in operating the site and, to the best of our knowledge, a number of qualified companies have expressed an interest in doing so.

As your letter recognizes, a complete resolution of the future status of the operation of the West Valley site is dependent upon the pending legislation calling for a High Level Waste Demonstration Project at the site. The status of that legislation should be clarified in the coming months. At that time, we would propose to conduct more detailed discussions with you regarding the future disposition of the site upon the expiration of the Lease.
