Dear Mr. Cunningham:

In response to the referenced letter concerning certain drums discovered at the Western New York Nuclear Services Center (" Center"), NFS submits the following information:

The drums, which were found in the spillway of the lake near the Center, were debris from a fire in a barn that had been utilized for storage of non-radioactive materials for which there was no room in the NFS warehouse. The barn was located outside the restricted area fence; thus, all material transferred to it was free of radioactive contamination. Subsequent to the fire, which damaged all of the stored materials, we used the scrap to fill erosion channels near the spillway.

We have been informed that the U. S. Department of Energy (" DOE") through its site contractor, West Valley Nuclear Services Co., Inc. ("WVNS"), and the New York St. ate Department of Health have made a thorough investigation of this area and have confirmed that there is no detectable radioactivity (over background) on the drums or in the area. Additionally, we understand that the DOE will be responding to you with details of their review of the matter and, thus, specific responses from NFS, Rockville, are not provided. If the NRC wishes NFS to comment on the response by DOE to the Sierrra Club's questions contained in its July 14,1982 letter, we will be pleased to do so.
