Items of Interest Week Ending October 8, 2021 NRC Issues Prompt Safety Concern Determination Regarding Aluminum Enhanced High Energy Arcing Faults On October 5, 2021, the staff issued a memo documenting completion of the first step using the LIC-504, Integrated Risk-Informed Decision-Making for Emergent Issues (ADAMS Accession No. ML19253D401) process to evaluate aluminum high energy arcing faults. The staff concluded that U.S. plants remain safe without any prompt regulatory action (ADAMS Accession No. ML21272A262). This conclusion was based on staff insights from a qualitative risk evaluation that considered safety margins and defense-in-depth features associated with fire protection programs and applicable operating experience at U.S. nuclear power plants.

Items of Interest Week Ending October 8, 2021 NMSS Staff Approves Emergency Exercise Extension for Global Nuclear Fuel-Americas On October 1, 2021, the staff approved the Global Nuclear Fuel-Americas (GNF-A) request for a one-time extension for conducting the 2021 biennial evaluated emergency exercise for its fuel fabrication facility located in Wilmington, North Carolina. GNF-A requested this exemption because COVID-19-related changing local conditions prevent them from safely conducting the biennial exercise as planned. The emergency exercise must be held by September 30, 2022.

NMSS Staff Approves Emergency Exercise Extension for Framatome On October 1, 2021, the staff approved the Framatome request for a one-time extension for conducting the 2021 biennial evaluated emergency exercise for its fuel fabrication facility located in Richland, Washington. Framatome requested this exemption because COVID related changing local conditions prevent them from safely conducting the biennial exercise as planned. The emergency exercise must be held by June 30, 2022.

On October 5, 2021, the NRC published a notice in the Federal Register (86 FR 54801) confirming the effective date of October 27, 2021, for the direct final rule that was published in the Federal Register on August 13, 2021 (86 FR 44594). The direct final rule amended the NRCs spent fuel storage regulations by revising the TN Americas, LLC, Standardized Advanced NUHOMS Horizontal Modular Storage System listing within the List of approved spent fuel storage casks to renew, for an additional 40 years, the initial certificate and Amendment Nos. 1, 3, and 4 of Certificate of Compliance No. 1029. The effective date of October 27, 2021, for the direct final rule published August 13, 2021, is confirmed.

On October 7, 2021, the NRC published a notice in the Federal Register (86 FR 55685) confirming the effective date of October 26, 2021, for the direct final rule that was published in Federal Register on August 12, 2021 (86 FR 44267). The direct final rule amended the TN Americas LLC, NUHOMS EOS Dry Spent Fuel Storage System listing in the List of approved spent fuel storage casks to include Amendment No. 2 to Certificate of Compliance No. 1042.

Amendment No. 2 revises the certificate of compliance to add a dry shielded canister for storage, add new heat load zone configurations, and make other changes to the storage system. Amendment No. 2 also changes the certificate of compliance and technical specifications and updates the final safety analysis report for consistency and clarity. The effective date of October 26, 2021, for the direct final rule published August 12, 2021, is confirmed.

Updates on the Export of Deuterium: Final Rule; 10 CFR Part 110 [NRC-2014-0201; RIN 3150-AJ45]

On October 6, 2021, the NRC published a notice in the Federal Register (86 FR 55476) revising its regulations to remove the NRCs licensing authority for exports of deuterium for non-nuclear end use. The responsibility for the licensing of exports of deuterium for non-nuclear end use is being transferred to the Department of Commerces Bureau of Industry and Security. The Bureau of Industry and Security published a final rule in the same edition of the Federal Register to include such exports under its export licensing jurisdiction. Exports of deuterium for nuclear end use will remain under the NRCs export licensing jurisdiction. This final rule is effective on December 6, 2021.

Items of Interest Week Ending October 8, 2021 NRC Staff Presented on Advanced Reactor Security Topics On October 4-5, 2021, the NRC participated in a virtual meeting hosted by the National Academies of Sciences, Engineering, and Medicines Committee on Laying the Foundation for New and Advanced Nuclear Reactors in the United States titled, Security, Safeguards, and International Issues for New and Advanced Reactors. Staff provided presentations on Security for Advanced Reactors Regulatory Framework, which gave an overview of the NRCs effort currently underway to modernize the security framework (ML21278A224); and NRC Preparations for Advanced Reactor Exports, which provided NRCs readiness to export advanced reactors (ML21194A213).
