Dear Senator Bentsen:

This responds to your letter of June 9,1989 which forwarded a letter from a  ;

constituent, J. C. Dodson. He expressed concerns regarding the future opera- l tion of the Comanche Peak Steam Electric Station and provided you with a copy of a May 16, 1989 article from the Fort Worth Star-Telegram about a recent event at the Comanche Peak plant.

The newspaper article briefly described the failure of several check valves j which occurred during preoperational testing of the auxiliary feedwater system. l This system normally carries water which would not be contaminated with radio- i activity if the plant were operating. A team of NRC inspectors has reviewed the event and its consequences. Ba-sed on these inspections, the NRC will assure that the applicant, Texas Utilities Electric Company, is taking all appropriate i corrective actions, including repairs to the auxiliary feedwater system and changes to the maintenance procedures to prevent a recurrence of the check l valve problem in any other system which utilizes similar valves.

Other concerns identified by Mr. Dodson include flaws in design and construction of Comanche Peak and general concerns about radioactive waste storage. Texas Utilities Electric Company is in the process of completing an extensive cor-rective action program to identify and remedy all design and construction concerns. The NRC staff has reviewed the corrective action program and has concluded that the program provides adequate means to identify and correct any design and construction deficiencies. Moreover, the NRC has been carefully monitoring the implementation of this program, as well as the applicant's testing activities, to ensure that Comanche Peak is designed and constructed in accordance with NRC regulations.

With regard to the issue of waste disposal, the NRC has a number of programs to implement the legislation enacted for the safe disposal of nuclear wastes. These programs include the licensing of a national repository for high-level wastes and state compacts to provide disposal sites for low-level wastes, as well as pro-viding the means to safely dispose of nuclear wastes produced by power reactors licensed to operate in Texas.
