ENCLOSURE 1 NOTICE OF VIOLATION Georgia Power Company Docket Nos. 50-321 and 50-366 Edwin I. Hatch Nuclear Plant License Nos. OPR-57 and NPF EA-87-111 During the Nuclear Regulatory Commission (NRC) inspection conducted on June 8-12, 1987, a violation of NRC requirements was identified. The violation involved failure to comply with DOT shipping requirements. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (1986), the violation is listed below:

10 CFR 71.5(a) requires each licensee who transports licensed material outside the confines of its plant or other place of use to comply with the applicable requirements of the regulations of the Department of Transportation (DOT) presented in 49 CFR Parts 170 through 189. -

49 CFR 173.441 (b) (1) requ$res that radiation levels at any point on the external surface of a package transported by exclusive use vehicle not axceed 1000 millirem per hour.

Contrary to the above, on February 27, 1987, the licensee failed to ensure compliance with DDT shipping requirements in that two metal boxes of radioactive material, shipment number 87-012-RW, were shipped to the low level radioactive waste disposal site near Barnwell, SC, with i radiation levels in excess of 1000 millirem per hour. One box, designated i as HPN-87-033, had a contact radiation level of 1300 millirem per hour and )

the other box, designated as HPN-87-034, had a contact radiation level of  :

2200 millirem per hour. l This is a Severity Ic<el III violation (Supplement V).

Pursuant to the provision of 10 CFR 2.201, Hatch Nuclear Plant is hereby ,

required to submit to this Office within 30 days of the date of the letter transmitting this Notice a written statement of explanation in reply including <

(1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and results achieved, (4) the corrective steps which will be taken to avoid further vi' olations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
