NOTICE OF VIOLATION

Southern Nuclear Operating Company. Inc. Docket Nos. 50-321. 50-366

Hatch Units 1 and 2 License Nos. OPR-57. NPF-5

During the NRC inspection conducted on October 5.1997 through Novemoer 15.

1997, violations of NRC requirements were identified, in accordance with the

" General Statement of Policy and Procedure for NRC Enforcement Actions." NUREG

1600. the violations are listed below:

A. Unit 1 iechnical Specifications 3.9.5. Control Rod Operability -

Refueling, specifies that each withdrawn control rod shall be

operable. Technical Specification Surveillance Requirement 3.9.5.2 requires each withdrawn control rod scram accumulatcr

pressure to be arcater than or equal to 940 psig to meet

operability regt.rements.

Contrary to the above on October 14, control rod 10 47 was

withdrawn to position 02 with the scram accumulator pressure less

than the required 940 psig.

This is a Severity Level IV Violation (Supplement 1). (Unit 1 only).

B. 10 CFR 20.1904(a) requires licensees to ensure that containers of

licensed material not subject to the exemptions of 10 CFR 20.1905

bear a durable. clearly visible label bearing the radiation symbol

and the words " CAUTION, RADICACTIVE MATERIAL or DANGER.

RAD 10ACllVE MATERIAL.~ The label must provide sufficient

information to permit individuals handling or using the

containers, or working in the vicinity o' the containers. to take

precautions to avoid or minimize exposures.

Contrary to 10 CFR 20.1904. as of October 22. 1997, the licensee

failed to label properly eight spent vacuum filters having maximum

contact dose rates ranging frorr. 4.7 to 7.5 rem per hour which were

suspended from tbn Unit 1 torus catwalk railing by lanyards for

temporary storage underwater. Licensee radiological controls for

personnel to access the area were not inclusive enough to meet the

exemptions specified in 10 CFR 20.1905(c) and 10 CFR 20.1905(e).

This is a Severity level 1r violation (Supplement IV). (Unit 1 only).

Pursuant to the previsions of 10 CFR 2.201. Southern Nuclear Operatina

Company. Inc. is hereby required to submit a written statement or explanation

to the U.S. Nuclear Regulatory Commission. ATIN. Document Control Desk.

Washingtori. D.C. 20555, with a copy to the Regional Administrator. Region 11.

and a copy to the NRC Resident inspector. Hatch Nuclear Plant, within 30 days

of the date of the letter transmitting this Notice of Violation (Notice).

This reply should be clearly marked as a " Reply to a Notice of Violation" and

should include for each violation: (1) the reason for the violation, or, if

contested. the basis for disputing the violation. (2) the corrective steps
