FITNES$ FOR DU1Y PROGRAM - CALLAWAY This responds to Union Electric Company's-letter of February -12,1990, which

requested clarifiu tion as to_whether there was an elapsed time between a first and subsecuert confirmed positive test which would allow the first-e positive- to be cir, regarded.

Title 10. Part'.26, section 26.27(b)(2) of the Code' of Federal _ Regulations states, "Any subsequent confirmed positive test must result in removal fromi unescorted access . . . " Any subsequent confirmed positive test, no matter' how many years:have elapsed, must be treated as a second: confirmed positive.

In the example you provided in your letter, the March-1993 occurrence (following a February 1990-first offense) would be a second offense.

Youcorrectlyaointoutthattherecordsretentionrequirementsof10CFR26.71(b) reflect that tse records of these tests and the related personnel records must be- kept for a' period of at _least five years. This is a' minimum retention period. Licensees must retain . records, however,_ as long as necessary to meet the purposes of the' rule.
