REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE FRAMATOME TECHNOLOGIES, INC.

Dear Mr. Kelly:

By letter dated April 7,1999, Union Electric Company (UE) provided additional information to the NRC staff. The additionalinformation pertains to UE's application for amendment to allow the installation of Framatome Electrosleeves in the Callaway Plant for two operating cycles. In their letter, UE provided a copy of a " white paper" prepared by Framatome Technologies, Inc.

(FTI) entitled " Evaluation of Severe Accident Simulation, dated April 1999. In their letter, UE indicated that FTl considered a portion of this document to contain information considered proprietary to FTI. UE provided a non-proprietary version of this document for placement in the public document rooms.

The UE submittal also included an affidavit dated April 2,1999, executed by you, for Framatome Technologies, Inc., which requested that the proprietary version of the document, entitled " Evaluation of Severe Accident Simulation," dated April 1999, be withheld from public disclosure pursuant to 10 CFR 2.790.

The affidavit stated that the proprietary version of the document entitled " Evaluation of Severe Accident Simulation," dated April 1999, should be considered exempt from mandatory public disclosure for the following reesons:

The information reveals data or material conceming FTl research or development plans or programs of present or potential competitive advantage to FTI.

c.

The use of the information by a competitor would decrease his expenditures, in time or resources, in design!ng, producing or marketing a similar product.

d.

The information consists of test data or other similar data conceming a process,

'j method or component, the application of which results in a competitive advantage

to FTI.

information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.

Therefore,' the FTl document entitled " Evaluation'of Severe Accident Simulation," dated April 1999 and marked as proprietary, will be withheld from the public disclosure pursuant to-10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and l

directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information, in all review situations, if the NRC makes a determination l

adverse to the above, you will be notified in advance'of any public disclosure.
