Dear Mr. Kelly:

By letter dated October 27,1998, Union Electric Company (UE) submitted an amendment application to allow the installation of Framatome electrosleeves in the Callaway Plant for two operating cycles. The following two documents were enclosures to the amendment application:

1. Framatome Technologies, Inc. Topical Report BAW-10219P, Rev 03, "Electrosteeving Qualification for PWR Recirculuing Steam Generator Tube Repair * October 1998.

2. " Risk Assessment for Installation of Electrosleeves at BVPS and Callaway Plant," FTl ,

included in the UE amendment application was an affidavit dated October 22,1998, executed by you for Framatome Technologies incorporated (FTI), which requested that all the documents included in the amendment application be withheld from public disclosure pursuant to 10 CFR 2.790. This affidavit was amended in a subsequent letter from UE dated February 25,1999, to identify that only the two above listed documents, included in the amendment application, should be withheld from public disclosure. A non-proprietary version of document #2 was provided in the amendment application for placement in the public document room. A non-proprietary version of document #1 was subsequently provided by UE letter dated November 13,1998 for placement in the public document room.

The affidavit stated that documents #1 and #2 above should be considered exempt from ,

mandatory public disclosure for the following reasons: l l

"b. The information reveals data or material concerning FTl research or development plans or programs of present or potential competitive advantage to FTI.

t c. The use of the information by a competitor would decrease his expenditures, in '

time or resources, in designing, producing or mtrketing a similar product. ( O d. The information consists of test data or other similar data concerning a process, method or component, the application of which results in a competitive advantage to FTI.

We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted

- information sought to be withheld contains proprietary commercialinformation and should be withheld from public disclosure.

Therefore, the version of the Submitted documents #1 and #2 marked as proprietary will be withheld from public disclosure pursennt to 10 CFR 2.790(b)(5) and Section 103(b) of the Atom'c Energy Act of 1954, as ame.%nt

. ' Withholding from public inspection shall not effect the right, if any, of persons properly and directly concemed to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of information Act request includes your information. In all review situations, if the NRC makes a determination ;

adverse to the above, you will be notified in advance of any public disclosure. i
