Mt This is to infom the Commission that a f;otice of Violatl'o and P osed Imposition of Civil Penalties in the amount of Fifteen Thousand Dollars will be issued on or about April 7,1981, to Georgia Power Company. This action is based on two alleged violations relating to inadequate sampling procedures which apparently allowed contaminated waste oil or an oil-water mix in 55 gallon drums to reach an unrestricte; area near the Edwin I. Hatch !iuclear meteorological tc.ter and resulted in radiatior, levels in excess of f;RC requirements. A potential existed for off-site release of contaminated waste oil; however, waste oil samples taken from waste oil vendor facilities indicated no radioactivity above background levels.

In accordance with provisions of the Interim Enforcement Policy, a 50*; reduction in the base civil penalty value ($40,000) for a Severity Level III Violation was made based on the licensee's identification, correction and reporting of the matter, and a further reduction of 25". was made for good faith shown by the licensee.

We call the Commission's attention to this first application of a good faith reduction of a civil penalty.

A news release has been prepared and will be issued about the time the licensee receives the Notice. The State of Georgia will be notified.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
