REVISED ORDER FOR MODIFICATION OF LICENSE I.

The Georgia Power Company (licensee) and three other co-owners are the holders of Facility Operating Licenses Nos. OPR-57 and NPF-5, which author-ize the operation of the Edwin I. Hatch Nuclear Plant, Units Nos.1 and 2, at steady state reactor power levels not in excess of 2436 megawatts thermal (rated power) for each unit.

The facilities consist of boiling water reactors located at the licensee's site in Applinc County, Georgia.

II.

On November 4,1977, the Union of Concerned Scientists (UCS) filed with the Commission a " Petition for Emergency and Remedial Relief." The petition sought action in two areas:

fire protection for electrical cables, and environmental qualification of electrical ~ components.

By Memorandum and Order dated April 13,1978 (7 NRC 400), the Commission denied certain aspects of the petition and, with respec.t to other aspec s, ordered the NRC staff to take several related actions.

UCS filed a Petition for Reconsideration on May 2,1978. By Memorandum and Order, dated May 23, 1980, the Commission reaffirmed its April 13, 1978 decision 8010270 i

Si7

i

. 0) s regarding the possible shutdown of operating reactors.

However, the i

Conmission's liay 23, 1980 decision directed licensees and the NRC staff to undertake certain actions.

~

With respect to environmental qualification of safety-related electrical' equipment, the Conmission determined that the provisions of the two

}

staff documents - the Division of Operating P.eactors " Guidelines for Evaluating Environmental Qualification of Class 1E Electrical Equipment I

in Operating Reactors" (DOR Guidelines) and NUREG-0588, " Interim. Staff 5

Position on Environmental Qualification of Safety-Related Electrical Equipment," December 1979 "f orm the recuirements which licensees; and k

a; lican:s must meet in crder c satisfy :ntse as;ects cf 10 CR Part E

EC, Appendix A General Cesign Criterion (3Z-9, which relate tc envi-rcnmental qualification of safe y-relatec e'.ectrical equipment."

The-Comissicn directed, for replacement parts in operating plants, "unless BJ here are sound reascns to the contrary, the 19 4 standard in NUREG-O5SE will apply." The Comission also directed the staff to complete its 1

review of the information sought from licensees by Bulletin 79-018. and.

Y to complete its review of environmental qualification of safety-related electrical equipment-in all operating plants, including the publication u

of Safety Evaluation Reports, by February 1,1981.- The Cormission 3=

e I

1 Bulletin 79-01B was not sent to licensees for plants under review as

,1 part of 'the staff's Systematic Evaluatior. Program.

The information scught by Bulletin 79-013 was requested 'rc: :nese licensees by a series of letters and neetings during the months of February and.liaren,

(

1980.

4

4 imposed a deadline that, "by no later than June 30, 1982 all safety-related electrical equipment in all operating plants shall be qualified i-to the D0R Guidelines or NUREG-0588."

The Commission requested the i

staff to, " keep the Commission and the public apprised of any further findings of incomplete environmental qualification of safety-related electrical equipment, along with corrective actions taken or planned,"

and requested the staff to provide bi-monthly progress reports to the

+

i Commi ssion.

t The Commission further directed the staff to add certain documentaticn i

requirements to each license after the specific requirements were approved ty the Ccmrission.

The Conrissien aisc pointed out tha the various deadlines irc : sed in its Orcer, "dc n : excuse a licensee from the I

cbligatien c modify c re: lace 'nzee ua:e e:uipment promptly."

Tne ir.forr.ation cEvelosed curing this prcceeding emphasizes the importance cf adequate docenentatien, the prompt coripietion of the review of environ-mental qualification of safety-related electrical equipment, and the crompt completion of any plant modification needed to assure conformance with the DDR Guidelines or NUREG-0585.

A significant aspect of this review is the timely submittal of environmen.al cualification information by

- e creratin; plant licensees tc enable the staff to ccmplete its review ir, accordance with the Com?.ission's Order.

to environments that'may exist folicwing postulated accidents.

These l

accidents are tcss of Coolant Accident and Main Steam Line Break inside containment, and High Enercy Line. Breaks inside and outside

. c ont a i nme nt.

In this connection the ' licensee was requested by IEE Bulletin 79-01B-f of January 14,19SO to provide a detailed review of the environmental qualification cf Class IE electrical equipment.

This review was.to include all equipment required to function under postulated accident conditions, both inside and outside the primary containment, and re::crize all conditicns spacified in :na :;115 tin.

Evidence of cyclification together with methcds and justificaticn, was requestec.

Clarification -was provided by supplemental inf ormation, briefings,.and -

in sone cases, meetings with'the licensee.

Timely completion.of the staff's review of environmental qualification of electrical equipment and timely comp'etion of needed modifications by 'the licensee is required to provi'de continuing reasonable assurance of public health 1

Land safety. -Such completion is dependent on the prompt receipt of.a

' complete response by the licensee to the staff's ' requests for information.

l However,.the licensee's response, to date, is incomplete.

i

'Therefore, I have concluded that the public health, safety, and interest 1-reouire that a firm schedule for the' timely submission of all the L-ir.forration previously requested by~ the staff shculd be established i

~ :y Orcer effective immeciately.
