Dear Mr. Saporito:

This -letter is in response to your letter of July 7,1990. In your letter you requested that this office either provide your organization with a transcript of an ACRS subcommittee meeting which took place on May 24, 1990, or have the transcript placed in the Local Public Document Room in Miami, Florida.

You appear to believe that this transcript should have been provided to you automatically. The Staff is obligated to inform the Board and parties to a proceeding of information which is relevant and material to issues in controversy before that adjudicatory board. The transcript in question here is neither relevant nor material- to any of the issues currently pending before the Appeal Board in the Turkey Point pressure / temperature limits proceeding.

As you know -the general issue-of reactor vessel embrittlement is not a matter in controversy in that proceeding. Therefore, the Staff is under no obligation to provide the ACRS meeting transcript to the Appeal Board, nor is it obliged to serve it on other participants in the proceeding.

As we stated in a previous letter to you, a copy of the transcript may be obtained from the Commission's Public Document Room. In addition, you may request information from this agency pursuant to the Freedom of-Information Act. I am forwarding your request to the appropriate office to be treated as a Freedom of Information Act request.
