SUBJECT:
NRC INSPECTION REPORT NOS. 50-250/97-02 AND 50-251/97-02 AND
Dear Mr. Goldberg:
This refers to the inspection conducted on February 3 - 7, 1997, at the Turkey
Point facility. The purpose of the inspection was to determine whether
activities authorized by the license were conducted safely and in accordance
with NRC requirements. At the conclusion of the inspection, the findings were
discussed with those members of your staff identified in tlie enclosed report.
The areas examined during this inspection are identified in the report.
Within these areas, the inspection consisted of selected examinations of
procedures and representative records, interviews with personnel, and
observation of activities in progress.
Based on the results of this inspection, the NRC has determined that a
violation of NRC requirements occurred. This violation is cited in the
enclosed Notice of V.iclation (Notice) and the circumstances surrounding it is
described in detail in the subject inspection report. The violation is of

concern because you failed to officially deny an individual unescorted access
when your actions did effectively deny access.
Based on that deficiency, you
failed to offer an individual the right to appeal that access authorization
decision, as specified under the provisions of 10 CFR 73.56.
You are required to respond to this letter and should follow the instructions
specified in the enclosed Notice when preparing your response.
T a NRC will
use your response, in part, to determine whether further enforcement action is
necessary to ensure compliance with regulatory requirements.
The material enclosed herewith contains Safeguards Information as defined by
10 CFR Part 73.21 and its disclosure to unautnorized individuals is prohibited
by Section 147 of the Atomic Energy Act of 1954, as amended.
Therefore, the
material will not be placed in the Public Document Room.
