In response to your Petition for Leave to Make Statement, please be advised that if it is determined that a hearing is necessary, your petition will be granted in accordance with the provisions of the limited appearance statements in 10 CFR 2.715. The Board will not take any limited appearance statements at the time of the March 21 oral argument, the purpose of which is to hear the positions of the parties as to whether a hearing is required.

Limited Appearance statements, such as the one you desire to make, are heard only after the Board has determined that a hearing is necessary in a particular case.
