This is in response to your letter dated October 12,1984, which requests an exemption from the requirements of 10 CFR 70.58(e) to determine a limit of error associated with each measured quantity shipped.

Our review has determined that your request to use an average rather than a specific number. of samples and analyses in the-cal.culation of limits of error for those cases where batches of the same materiar type are listed on the same DOE /NRC Form 741 is acceptable. We have further determined that the granting of the request will not decrease the effectiveness of your safeguards program, and will not adversely affect the comon defense and security nor the public health and safety, and is otherwise in the public interest. Accordingly, we are adding the following license condition to Amendment SG-1 to your License No. SNM-1097, effective imediately, to read as follows:

4.8 "Notwithstanding the requirements of 10 CFR 70.58(e) to determine a limit of error associated with each measured quantity shipped under the cover of DOE /NRC Form 741, the licensee may use an average number of samples and analyses in the calculation of limits of error for those cases where batches of the same material type are listed on the same transfer document DOE /NRC Form 741."

We have determined that the attachment to your October 12, 1984 letter contains information of the type specified in 10 CFR 2.790(d). Accordingly, pursuant to i Section 2.790(d)(1), such information is deemed to be comercial or financial l within the meaning of 10 CFR 9.S(a)(4), and shall be withheld from public disclosure, unless subject to the provisions of 10 CFR 9.12.
