REQUEST FOR EXTENSION TO THE FUNDAMENTAL NUCLEAR MATERIAL CONTROL PLAN COMMITMENTS (TAC NO. L31087)

Dear Mr. Murray:

In accordance with your correspondence dated June 30,1998, and pursuant to Part 70 to Title 10 of the Code of Federal Regulations, Materials License SNM-1097 is hereby amended to allow the requested time extension to certain specified commitments in the Fundamental Nuclear Material Control (FNMC) Plan. Accordingly, new Safeguards License Condition SG-1,4 is being issued, effective immediately, and reads as follows:

SG-1.4 Notwithstanding the commitment, in Section 7.1 of the' FNMC Plan identified in Condition SG-1.1, to perform receipt measurements and distribute DOE /NRC Form 741 within 30 days, the licensee shall have 60 days (from the date the U.S.

Customs releases the material) to fulfill the above stated commitments relative to the 980 containers of UO2powder identified in the attachment to its letter dated June 30,1998.

In addition, notwithstar. ding the commitments in Sections 6.1 and 6.2.3 of the FNMC Plan identified in Condition SG-1.1 to provide current knowledge and audit verification of all SNM items, the licensee shall maintain the above-mentioned material in seavans in the Customs bonded area and enter these items in its inventory and item control program when the material is released.

The deviations from Sections 6.1,6.2.3, and 7.1 of your FNMC Plan were requested and approved pursuant to 10 CFR 70.34. The granting of your request was based on our determination that, in view of the specific circumstances, the additional time requested was justified and warranted.

We also revised Safeguards License Condition SG-1.1 to update our previous approval of your November 13,1997, submittal. Revised Condition SG-1.1 of your Materials License SNM-1097 reads as follows:

Accordingly, said enc!osures will be withheld j from public disclosure unless subject to the provisions of 10 CFR 9.23. '
