Enclosed is a report from Brookhaven National Laboratory, a Region III Contractor, addressing observations and recommendations based on their review of the Midland Surveillance and Maintenance Program. While we acknowledge your recent announcement that you are seeking approval from the Michigan Public Service Commission to convert the station to natural gas we note that dt this time, you plan retention of the Midland Construction permit and maintenance of the operating license application in an inactive state.

Consequently, we will maintain the observations and recommendations on the Midland open items list until such time as we determine whether any additional followup inspection is needed.

Although no specific violations were identified as the result of the inspection, our evaluation indicates that the items identified could have an impact on any later nuclear project restart. For example, some of the items relate to timely storage and layup of the reactor vessel, steam generators, service water and component cooling water systems. These items are an important aspect of the Surveillance and Maintenance Program.

Accordingly, you are requested to provide this office, within 60 days of receipt of this letter, your written evaluation of the observations and recommendations set forth in the report.
