Dear Ms. Diggs:

Your recent letter (Reference (d)), noted that the license fee ($150.00) required pursuant to 10CFR 170 was not remitted with New Hampshire Yankee (NHY) letter dated Octo>er 29, 1987 (Reference (b)). It should be noted that Refereace (b) was not an Application for Amendment of License (10CFR 50.90).

As n)ted in Reference (b), the information transmitted by NHY resulted from discassions with the Staff regarding relocation of three seismic monitors. In the Staff response (Reference (c)) to the NHY letter, the Staff indicated that their review of the proposed new locations was reasonable and complied with appropriate regulatory requirements. Furthermore, the Staff did not issue to NHY either an amendment to our Operating License or the subject Technical Specifications.

In summary, NHY does not believe that the application amendment fee, to which you refer, applies in this instance. NHY also believes that the Staff costs for review can be applied thrcugh the annual licensing fees.
