. Application for Amendment to Construction Permit

Dear Mr. Denton:

By letter dated May 11, 1984, Duke Power Company requested an exemption from the requirements of 10 CFR Part 50, Appendix A. General Design Criteria (GDC) 4 as it relates to the dynamic effects associated with the Reactor Coolant System main loop pipe breaks.

Duke Power Company, acting for itself and as agent for the North Carolina Municipal Power Agency Number 1 and the Piedmont Municipal Power Agency.

-hereby requests that the construction permit be amended to reflect this exemption upon its issuance.

Paragraph 3 of the Construction Permit states,-in part, as follows:

L This permit shall be deemed to contain and be subject to_the conditions specified in Section 50.54 and

- 50.55 of said regulations; is subject to all applicable provisions of the Act, and rules, regulations, and

order of the Commission now or hereafter in effect:...

We request that Paragraph 3 be amended by inserting ", as modified by duly authoriz'ed exemptions" af ter the words "in effect" and before the semicolon.

We also request that Paragraph 3.C.of the Construction Permit be revised by inserting the parenthetical phase and the word "in" after the word-

"and," as follows:

... construct the facility described in the application (as modified by duly authorized exemptions) and in the hearing record, in accordance...
