Duke Energy Corporation Catawba Nuclear Station, Units 1 and 2 Docket Numbers 50-413 and 50-414 I Proposed Technical Specifications Amendment Technical Specification 4.8.1.1.21.2, Diesel Generator Fuel Oil System TAC Numbers MA2461 and MA2462 Pursuant to 10 CFR 50.90,. Duke Energy Corporation is requesting an exigent mmendment to the Catawba Nuclear Station Facility Operating License and Technical T'acifications (TS). This amendment applies to the TS irements for the diesel generator fuel oil system.

Specifically, the proposed amendment deletes Surveillance Requirement (SR) 4.8.1.1.2i.2 for the pressure test of the system. Catawba presently conducts alternate testing of this system in accordance with ASME Section XI Code Case N-498-1. Approval to use this code case was granted by the NRC on February 13, 1995 in response to a relief request submitted by Duke Energy.

This proposed TS mmendment impacts the Catawba Improved Technical Specifications (ITS) conversion license amendment submittal. The Catawba ITS conversion license mmendment was submitted to the NRC on May 27, 1997. Accordingly, the necessary revised ITS submittal documentation is also included in this amendment request package. 3 l

U.S. Nuclear Regulatory Commission August 6, 1998 Page 2 Attachments 3a and 3b provide the revised ITS submittal documentation for Catawba Units 1 and 2, respectively.

Attachment 4 provides a description of the proposed changes and technical justification. Pursuant to 10 CFR 50.92, Attachment 5 documents the determination that the amendment contains No Significant Hazards Considerations. Pursuant to 10 CFR 51.22(c)(9), Attachment 6 provides the basis for the categorical exclusion from performing an Environmental Assessment / Impact Statement.

Implementation of this amendment to the Catawba Facility Operating License and TS will not impact the Catawba Updated Final Safety Analysis Report (UFSAR).

Duke is requesting NRC approval of this amendment request on an exigent basis pursuant to the request for enforcement discretion granted by the NRC on August 6, 1998 for Catawba Unit 1 concerning this issue. This exigent request is necessary because Catawba has determined that the requirements of SR 4.8.1.1.2i.2 are not being met for Unit 1 and cannot be met for Unit 2. This determination was made as a result of the conduct of a review of TS SRs in conjunction with implementation of the ITS at Catawba. This exigent request is being made pursuant to 10 CFR 50.91(a) (6) (vi) . The circumstances surrounding the request for enforcement discretion will be reported to the NRC in a Licensee Event Report.

In accordance with Duke administrative procedures and the j Quality Assurance Program Topical Report, this proposed l amendment has been previously reviewed and approved by the  !

Catawba Plant Operations Review Committee and the Duke Corporate Nuclear Safety Review Board.

Pursuant to 10 CFR 50.91, a copy of this proposed amendment is being sent to the appropriate State of South Carolina official.
