Technical Specifications Amendment Technical Specification 3/4.4.3, Pressurizer TAC Numbers MA1923 and MA1924 Pursuant to 10 CFR 50.90, Duke Energy Corporation is requesting-an exigent amendment to the Catawba Nuclear Station Facility Operating License and Technical Specifications (TS). This amendment applies to the TS requirements for the pressurizer. Specifically, the proposed amendment modifies Surveillance Requirement (SR) 4.4.3.3 for the pressurizer heators to change the existing requirement to be consistent with the plant design and with the TS requirement as delineated in the Improved Technical Specifications (ITS) for Catawba. The Catawba ITS amendment was submitted to the NRC on May 27, 1997 and is presently j undergoing NRC review. Necessary changes to the Catawba ITS I submittal resulting from this amendment request will be submitted under separate correspondence.

The contents of this amendment request package are as follows: i Attachments la and 1b provide a marked copy of the affected current TS 1; ages for Catawba Units 1 and 2, respectively, showing the proposed changes. Attachments 2a and 2b are reprinted pages of the affected current.TS pages.

Attachment 3'provides a description of the proposed changes and' technical justification.

. Hazards Considerations.

Pursuant to 10 CFR 51.22 (c) (9) , Attachment 5 provides the basis for the categorical exclusion from performing an Environmental Assessment / Impact Statement.

Implementation of this amendment to the Catawba Facility Operating. License and TS will impact the Catawba Updated Final Safety Analysis Report (UFSAR). Necessary changes to the UFSAR will be made in accordance'with 10 CFR 50.71(e).

Duke is requesting NRC approval of this amendment request on an exigent basis. pursuant to the request for enforcement l discretion granted by the NRC on May 22, 1998 concerning l this issue. This exigent request is necessary because Catawba has determined that the requirements of SR 4.4.3.3 are not being met in their entirety. This' determination was made as a result of the conduct of a review of TS SRs to ensure literal compliance. This exigent request is being made pursuant to 10 CFR 50.91(a) (6) (vi) .

In accordance with Duke administrative procedures and the Quality Assurance Program Topical Report, this proposed

Catawba Plant Operations Review Committee and the Duke Corporate Nuclear Safety Review Board.
