Impact of Regulatory Backfitting

Dear Mr. Tourtellotte:

Mr. Wendell J. Kelley has asked me to respond to your letter of February 8, 1983 regarding the impact of regulatory backfitting on the cost of nuclear power plants. We feel that this is an extremely important matter and that any -

positive measures which you can effect to better control the chronic problems resulting from backfitting will help the industry.

After careful review and several attempts we have been unable to develop the information requested in your letter, principally because we do not have an operating plant to use as a baseline for comparison. Some baseline is needed to provide analyses validity such as you provided as examples in your letter. We attempted to develop an alternative approach using available cost data developed during the design and current construction of Clinton Pcwer Station. However, the conclusion was that at this stage of the project, this alternative approach did not produce comparable, useful data. ,

I wish to reemphasize the importance which we recognize in connection with the backfitting evaluation which you are currently undertaking. If there is any other way in which we can be of assistance in supporting your effort, please do not hesitate to contact us.
