, APPENDIX A NOTICE OF VIOLATION Borough of Pottstown Docket No. 99990001 Pottstown, Pennsylvania 19464 General License As a result of the inspection conducted on June 28, 1985, and in accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C), the following violations were identified:
- A. CFR 31.5(c)(2) requires that the device be tested for leakage of radio-active material at no longer than three year intervals.
i Contrary to the above, as of June 28, 1985, it is not known when a leak test was conducted on a sealed source containing 200 millicuries of cesium-137.
This is a Severity Level IV violation (Supplement VI).
B. 10 CFR 31.5(c)(1) requires that all labels affixed to the device at the time of receipt and bearing a statement that removal of the label is prohibited be maintained.
Contrary to the above, as of June 28, 1985, labels affixed to the gauge were not maintained. Specifically, the labels were not legible.
This is a Severity Level IV violation (Supplement VI).
Pursuant to the provisions of 10 CFR 2.201, the Borough of Pottstown is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
