ENCLOSURE 1 NOTICE OF VIOLATION WITH NO RESPONSE REQUIRED Boston Edison Company Docket No.

50-293 Pilarim Station License No.

DPR-35 EA 98-337 During an NRC inspection conducted on June 9,1998 through July 25,1998, two violations of NRC requirements were identified, in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violations are listed below:

10CFR 50, Appendix R, Section Ill.G, Fire Protection of Safe Shutdown Capability, specifies for those systems necessary to achieve and maintain hot shutdown conditions that are located in the same area outside of containment, that one of the redundant trains remains free from fire damage by provisions, including separation of the redundant trains by a fire barrier having a 3-hour rating.

The Pilgrim Safe Shutdown Analysis, Section 4.4, identifies that fire enclosure 194.5018-encl. 3, which protects "A" train power cables, was designed and rated as a 3-hour barrier.

Contrary to the above, from 1980 to June 9,1998, the licensee failed to maintain provisions to ensure that one train of cables were free from fire damage, in that a

defect on fire barrier 194.501B-encl. 3 rendered the fire barrier inoperablo and unable to meet its 3-hour rating.

This is a Severity Level IV violation (Supplement 1).

Pilgrim License Condition 3F, Fire Protection, requires that BEC Energy shall implement and maintain in effect all provisions of the approved fire protection program.

Both the Pilgrim Undated Fire Hazards Analysis Report, step 3.2, part of the approved fire protection program, and the Pilgrim Quality Assurance Manual, step 2.4, specify that the quality assurance program applies to activities affecting fire protection systems and equipment required to limit fire damage.

The Pilgrim Quality Assurance manual, step 16.1, specifies that conditions adverse to quality be promptly identified and corrected.

Contrary to the above, from 1996 to June 9,1998, the licensee failed to promptly correct the following conditions adverse to quality which were identified in Quality Assurance Audit 96-04:

The in.=talled configurations of three electrical raceway fire barriers were not tested in the same installed configuration.

A gap in fire barrier 194.504C-encl. 2 was not repaired in a timely manner.

l c.

Fire Protection Engineering Evaluations 4,61 and 101 were not reviewed for adequacy.

This is a Severity Level IV violation (Supplement 1).

l The NRC has concluded that information regarding the reasons for the above two l

violations, the corrective actions taken and planned to correct the violations and prevent recurrence, and the date when full compliance was achieved is already adequately addressed on the docket in LERs 98-12 and 98-13 and in NRC Inspection Reports 50-293/98-05 and 06. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or position. in that case, cr if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident inspector at the facility that is subject to this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

If you contest this enforcement action, you should also provide a copy of your response to the Director, Office of Enforcement, United States Nuclear Regulatory Commission, 5-0001.
