ENCLOSURE 1 NOTICE OF VIOLATION GPU Nuclear incorporated Docket No. 50-219 Oyster Creek Nuclear Generating Station License No. DPR-16 During an NRC inspection conducted September 14 - October 25,1998, one violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procediire for NRC Enforcement Actions," NUREG-1600, June 30,1995, the violation is listed below:

Licenseo Condition 2.C(4) of Licensen No. DPR-16 requires that the licensee fully implement and maintain in effect all :

visions of the Commission-approved physical security plan. The NRC-approved Oy.er Creek Nuclear Generating Station Physical Security Plan specifies site access controlin procedure OSEC-lMP-1530.01, PersonnelIdentification and Site Access Control. Procedure OSEC-lMP-1530.01, Revision 10, Step 4.8.4 requires, in part, that vehicles, other then licensee-designated vehicles, shall be escorted while movina insive the protective area. No escort is required when the vehicles are immobilized. When any vehicle is left unattended within the protected area the vehicle must be ignition locked and the keys removed. When vehicles other than " licensee-designated" vehicles, are left unattended within the protected area, the ignition keys shall be in the possession of the Security Department.

Contrary to the above, at approximately 10:30 a.m. on October 14,1998, a security force vehicle escort left a non licensee-designated vehicle unattended in the protected area and failed to ensure that the vehicle was ignition locked with the keys removed and did not ensure that the keys were in the possession of the Security Department. Specifically, a security force vehicle escort left an unlocked and running commercial trash truck unattended in the protected area. The condition existed for approximately five minutes.

This is a Severity Level IV violation (Supplement Vil).

The NRC has concluded that information regarding the reason for the violation, the corrective actions taken to correct the violation and prevent recurrence and the date when full compliance was achieved is already adequately addressed in this inspection report.

However, yco are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if die description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to respond, clearly mark your response as a

" Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident inspector within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

If you contest this enforcement action, you should also provide a copy of your response to the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001.
