ENCLOSURE 1 NOTICE OF VIOLATION Northeast Nuclear Energy Company Docket No.: 60-423

. Millstone Nuclear Power Station License No.: NFP-49 Unit 3 During an NRC inspection conducted on April 28,'1998 through June 29,1998, a violation of NRC requirements was identified, in accordance with the '" General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

' A. Technical Specification C.8.1.a. requires, in part, that written procedures shall be implemented covering the activities referenced in Appendix A of Regulatory Guide 1.33, February 1978, item 2.a., General Plant Operating Procedures, " Cold Shutdown to Hot Standby." Step 4.2.34.g.2 of OP 3201, " Plant Heatup," states, IF any RCS hot or cold leg WR temperature increases to greater than 195 *F, DIRECT test personnel to close and lock the applicable RHR outboard drain valve (3RHS*V26).

Contrary to the above, on June 2,1998, the licensee failed to direct test personnel to close and lock RHR outboard drain valve,3RHS*V26, when RCS WR temperature increased to greater than 195'F. Valve 3RHS*V26 was subsequently closed when reactor coolant system wide range temperature approached 197

  • F during performance of SP 3601F.4,"RCS Pressure 1 solation Valve Test."

This is a Severity LevelIV violation (Supplement 1) for Docket No. 50-4'23.

Pursuant to the provisions of 10 CFR 2.201, Northeast Nuclear Energy Company is hereby ,

required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident inspector at the facility that is the mbject of this Notice within 30 days of the receipt of the letter transmitting this Notice of Violation (Notice). Th!s reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation or severity level, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response. If nn adequate reply is not received within the time specified in this Notice, an order or a Demand for information may
