l i ENCLOSURE 1 NOTICE OF VIOLATION New York Power Authority Docket No. 50-333 James A. FitzPatrick Nuclear Power Plant License No. DPR-59 During an NRC inspection conducted from October 5 to November 22,1998, a violation of NRC requirements was identified, in accordance with NUREG 1600, the " General Statement of Policy and Procedure for NRC Enforcement Actions," the violation is listed below:

10CFR50, Appendix B, Criteria 111, Design Control, requires that the design basis for systems, structures and components be correctly translated into specifications and I instructions. The final safety analysis report (FSAR), section 7.1.9, states that all cabling inside the primary containment is routed inside of conduit.

Contrary to the above, modification DI-96-007, " Replacement of MSSRV 3-veay I C$noid Valves," conducted during a February 1996, forced outage installed

cabling to the MSSRV solenoid valves without the use of conduit. l 1

This is a Severity level IV violation (Supplement 1).

i The NRC has concluded that information regarding the reason for the violation, the  ;

corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance was achieved is already adequately addressed on the docket

to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position, in that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation,"

and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555 with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident inspector at the facility that is the subject of this notice, within 30 days  !

of the date of the letter transmitting this Not!ae of Violation (Notice).

If you contest this enforcement action, you should also provide a copy of your response to the Director, Office of Enforcement, Unites States Nuclear Regulatory Commission, Washington, DC 20555-0001.
