Dear Dr. Batzer:

l On December 1,1998, Mr. Steve Courtemanche of this office conducted a safety inspection at I

, the above address of activities authorized by the above listed NRC license. The inspection was l limited to observations by the inspector, interviews with personnel, and confirmatory surveys of j radioactive waste materials left in a 55-gallon drum outside of your facility. The findings of the j inspection were discussed with you and Helaine Wallace of your organization at the conclusion of the inspection. The enclosed report presents the results of this inspection.

' Within the scope of this inspection, no violations were identified.

Please note that the inspection results do not constitute approval by the NRC of the manner in which radioactive material was left outside of your facility in the public domain. 10 CFR 31.11(f) ,

exempts you from many of the requirements of 10 CFR Parts 19,20, and 30, however, if the l radioactive waste had been picked up by a waste broker instead of being retrieved by your organization, a violation of 10 CFR 20.2001 would have occurred. We understand from conversations with your staff that the radioactive waste has been secured and that it will be '

transferred to a radioactive materials waste broker for disposalin the near future, if this  ;

understanding is incorrect, please inform us in writing. l In accordance with Section 2.790 of the NRC's " Rules and Practices," Part 2, Title 10, Code of Federal Regulations, a copy of this letter will be placed in the Public Document Room. No reply )
