NOTICE OF VIOLATION New York Power Authority Docket No. 50-333 James A. FitzPatrick Nuclear Power Plant License No. DPR 59 in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," (60 FR 34381; June 30,1995), the following violation was identified:

10 CFR 50, Appendix B, Criterion ill, " Design Control", requires that applicable regulatory requirements and the design basis for safety-related systems and components are correctly translated into the plant's design.

Contrary to the above, NYPA did not correctly translate the applicable design basis for safety-related systems and components into the plant's design in that the effects of a short circuit on the protection scheme for certain containment penetrations were not analyzed, per the design bases for the conditions of a loss of coolant accident coincident with a loss of offsite power.

This is a Severity Level IV Violation (Supplement I).

The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance was achieved is already adequately addressed on the docket in Inspection Report 50-333/98-05, dated September 28,1998. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the i description therein does not accurately reflect your corrective actions or your position. In I that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document l Control Desk, Washington, DC 20555 with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident inspector at the facility that is the subject of this notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
