NOTICE OF VIOLATION Nebraska Public Power District Docket No.: 50-298 Cooper Nuclear Station License No.: DPR-46 During an NRC inspection conducted on February 6-10, 1989, violations of NRC requirements were identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1989), the violations are listed below:

A. Inadequate Compensatory Measures License Condition 2.C(3) of Amendment 111 to the Cooper Nuclear Station Facility Qperating License, dated February 25, 1981, requires that the licensee fully implement and maintain in effect all provisions of the Commission-approved Security Plan for the Cooper Nuclear Station and the Cooper Nuclear Station Safeguards Contingency Plan, including amendments and changes made pursuant to the authority of 10 CFR 50.54(p).

Section 9.2 of the licensee's Physical Security Plan requires the licensee to implement compensatory measures for degraded security systems that assure an equivalent level of protection and meet the performance objectives of 10 CFR 73.55(a).

Contrary to the above, on three separate occasions, the licensee failed to provide adequate compensatory measures for a degraded assessment aids system. On August 25, 1987, and October 29, 1988, the licensee discovered i two security officers sleeping at their compensatory posts. On September 5, 1988, the licensee discovered a compensatory officer reading a book instead j of observing the degraded zone.

This is a Severity Level IV violation. (SupplementIII) 1 B. Failure to Report 10 CFR 73.71(b) requires that the licensee report certain types of events, as described in Appendix G, Part 73, within one hour of the discovery of 3 the event. Appendix G Section 1(r.) includes among the required one hour '

reports any event in which a person has caused a degradation of the safeguards system that could allow unauthorized or undetected access to a vital area. I

Contrary to the above, the licensee failed to report three separate incidents of inadequate compensatory measures for a degraded assessment aids system. Two of the incidents occurred (August 25, 1987, and October 29,1988) when compensatory officers were discovered sleeping.

The third incident occurred on September 5,1988, when a compensatory officer was discovered reading a book instead of observing the degraded assessment aids zone.

Notice of Violation Pursuant to the provisions of 10 CFR 2.201, Nebraska Public Power District is hereby required to submit to this office, within 30 days of the date of the letter transmitting this Notice, a written statement ur explanation in reply, including for each violation: (1) the reason for the violation if admitted, i (2) the corrective steps which have been taken and the results achieved, (3)thecorrectivestepswhichwillbetakentoavoidfurtherviolations,and (4) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.
