ENCLOSURE 1 NOTICE OF VIOLATION l

l Nebraska Public Power District Docket No.: 50-298 i Cooper Nuclear Station License No.: DPR-46 4

j During an NRC inspection conducted on November 18-22 and December 9-13,1996, two  !

violations of NRC requirements were identified. In accordance with the " General i Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the I violations are listed below-

)

A. Technical Specification 6.2.1.A.4.e, requires a review of station operation by the Station Operations Review Committee so that potential nuclear safety hazards could be detected.

Contrary to the above, during the period of July 2 through November 25,1996, the Station Operations Review Committee did not review station operations to detect potential nuclear safety hazards (Section 01.2) l This is a Severity Level IV violation (Supplement 1) (50-298/9625-01).

B. 10 CFR Part 50, Appendix B, Criterion XVI, requires, in part, that measures be established to assure that conditions adverse to quality, such as failures, malfunctions, deficiencies, deviations, defective material and equipment, and l nonconformances are promptly identified and corrected. In the case of significant  ;

conditions adverse to quality, the measures shall ensure that the cause of the l condition is determined and corrective action taken to preclude repetition.

Contrary to the above, on November 20,1996, one of the corrective actions for Quality Assurance Audit 96-08, which included revising Procedure O. , Control of Combustibles," personnel training on this revision, and interim plant walkdowns to identify and correct transient combustible control problems, was inadequate.

Specifically, the plant walkdowns f ailed to identify and correct three transient combustible control problems (Section F8).

This is a Severity Level IV violation (Supplement 1) (50-298/9625-07).

Pursuant to the provisions of 10 CFR 2.201, Nebraska Public Power District is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV,611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, ard a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and i (4) the date when full compliance will be achieved.
