During an NRC inspection conducted on November 2 through December 13,1997,one
violation of NRC requirements was identified. in accordance with the " General Statement
'
of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violr'. son b listed
below:
10 CFR Part 50, Appendix B, Criterion V, requires, in part, that activities affecting
quality shall be prescribed by procedures of a type appropriate to the circumstances.
These procedures shallinclude appropriate quantitative or qualitative acceptance
criteria for determining that important activities have been satisf actorily
accomplished.
Contrary to the above, as of December 13,1997, Procedure 6.SC.502, " Secondary
Containment Penetration Examination," Revision 2, which conducts an assessment
of air in leakage through redundant secondary containment doors, an activity
affecting quality, was not appropriate to the circumstances in that it did not include
appropriate acceptance criteria. This procedure summed the minimum door leakage
in each set of two doors to establish the secondary containment in leakage rate. The
use of the minimum in leakage for each door set was potentially nonconservative.
This is a Severity Level IV violation (Supplement I) (50 298/9710-01).
Pursuant to the provisions of 10 CFR 2.201, Nebraska Public Power District is hereby
required to submit a written statement or explanation to the U.S. Nuclear Regulatory
Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the
Regional Administrator, Region IV,611 Ryan Plaza Drive, Suite 400, Arlington, Texas
76011, and a copy to the NRC Resident inspector at the f acility that is the subject of this
Notice, within 30 days of the date of the letter transmitting this Notice of Violation
(Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and
should include for sach violation: (1) the reason for ^e violation, or, if contested, the basis
for disputing the violation, (2) the corrective steps that have been taken and the results
achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the
date when full compliance will be achieved. Your response may reference or include
previous docketed correspondence, if the correspondence adequately addresses the
- required response, if an adequate reply is not received within the time specified in this
Notice, an order or a Demand for Information may be issued as to why the license should
not be modified, su> pended,' or revoked, or why such other action as may be proper should
not be taken. Where good cause is shown, consideration will be given to extending the -
response time.
