Nebraska Public Power District Docket: 50-298 Cooper Nuclear Station License: DPR-46 During an NRC inspection conducted on July 11-15, 1994, a violation of NRC requirements was identified. In accordance with the General Statement of Policy and Procedure for NRC Enforcement Actions, "10 CFR Part 2, Appendix C,"

the violation is listed below:

Cooper Nuclear Station Safeguards Plan, Revision 30 dated October 28, 1993, paragraph 1.2.2, " Personnel Reliability," states, in part,

" Effective April 27, 1992, Nebraska Public Power District will adhere to the provisions of 10 CFR 73.56, " Personnel Access Authorization Requirement For Nuclear Power Plants." All elements of Regulatory Guide 5.66 will be implemented to satisfy the requirements of 10 CFR 73.56.

Paragraph 1.5.1.1 of the Safeguards Plan states, in part, "Only persons having a 'need to enter' the protected and vital areas shall be granted unescorted access." Access lists approved by the Senior Manager of Site 1 Support or his designee identifying these individuals will be maintained at Access Control, Secondary Alarm Station, and Central Alarm Station.

Access lists will be revalidated and approved at least once every 31 days. Regulatory Guide 5.66, Section B.3, also addresses the reinstatement of access authorization, i

l Contrary to the above, on July 14, 1994, the inspector identified one individual with a valid keycard that had not used the keyr.ard since December 30, 1993. The individual had not been under the licensee's continuous behavioral observation program the entire period and, with a 1 valid keycard on file, the individual could have entered the protected l area at anytime of his choosing. In addition, the licensee informed the inspector on July 20, 1994, that at least 28 additional individuals were identified who also had not been under the continuous behavioral observation program for 31 days or more.  !

This is a Severity Level IV Violation (Supplement III)(VIO 298/9420-01).

Pursuant to the provisions of 10 CFR Part 2.201, Nebraska Public Service Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555 with a copy to the Regional Administrator, Region IV, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice DOCUMENT CONTAINS ENCLOSURE CONTAINS l SAFEGUARDS INFORMATION SAFEGUARDS INFORMATION UPON SEPARATION THIS PAGE IS DECONTROLLED f O$hh9g l PDR l I

DOCUMENT CONTAINS SAFEGUARDS INFORMATION of Violation (Notice), within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (I) the reason for the violation or, if contested, the basis for disputing the violation, (2) the corrective steps that will be taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given for extending the response time.
