ENCLOSURE 1 NOTICE OF VIOLATION Nebraska Public Power District Docket No.: 50-298 Cooper Nuclear Station License No.: DPR 46 During an NRC inspection conducted on October 4 through November 14,1998, two violations of NRC requirements were identified. in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violations are listed below:

A. Technical Specification 5.4.1 requires, in part, that written procedures be established, implemented, and maintained that meet the applicable procedures recommended in Appendix A of NRC Regulatory Guide 1.33. Appendix A of NRC Regulatory Guide 1.33 requires procedures for startup, operation, and shutdown of safety-related systems, including the closed cooling water system and the emergency core cooling system.

l Contrary to the above, on October 1,1998, the inspectors identified that, between

January 25 and September 16,1998, the licensee failed to properly maintain procedures governing the operation of the reactor equipment cooling and turbine equipment cooling systems in that information contained in Operations Standing Orders implemented changes to the actions for monitoring the reactor equipment cooling system for leakage, removing loads from reactor equipment cooling system, and operation of the turbine equipment cooling system. The licensee did not properly maintain operating procedures in that they did not incorporate the changes in plant operation reflected in the standing orders.

l This is a Severity Level IV violation (Supplement 1).

B. 10 CFR Part 50, Appendix B, Criterion XVI, requires, in part, that measures shall be l established to assure that conditions adverse to quality, such as failures, malfunctions, deficiencies, deviations, defective material and equipment, and nonconformances are promptly identified and corrected. In the case of significant conditions adverse to l quality, the measures shall assure that the cause of the condition is determined and corrective actions taken to preclude repetition.

l Contrary to the above,in the licensee's reply to the Notice of Violation dated October 9, 1997, as part of the corrective actions in response to inappropriate test requirements, was to open torus-to-drywell vacuum breakers to equalize the pressure between the drywell and torus prior to performing as found testing. On August 2,1997, the licensee opened six vacuum breakers prior to performing as-found lif t test making the test invalid.

Repetition of the inappropriate test requirements was not precluded by the licensee's corrective action.

This is a Severity Level IV violation (Supplement 1).

The NRC has concluded that information regarding the reason for the violations, the corrective actions taken and planned to correct the violations and prevent recurrence and full compliance was achieved and adequately addressed in NRC Inspection Report 50-298/98-07. you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV,611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and a copy to the NRC Resident inspector at

. the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

If you contest this enforcement action, you should also provide a copy of your response with the basis for your denial to the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001.

If you choose to respond, your response will be placed in the NRC Public Document Room (PDR). Therefore, to the extent possible, the response should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction. If personal privacy or proprietary information is necessary to provide an acceptable response, then please provide a bracketed copy of your response that identifies the information that should be protected and a redacted copy of your response that deletes such information.
