Gentlemen:

This refers to the February 6-10, 1989, inspection conducted by Mr. A. B. Earnest of activities authorized by NRC Operating License DPR-46 for Cooper Nuclear Station, and to the discussion of our findings with you and other NPPD officials at an enforcement conference in our Arlington, Texas, offices on May 11, 1989.

This inspection reviewed certain areas of your physical security program. The areas inspected and the inspection findings are documented in NRC Inspection Report 50-298/89-06, which was mailed to you on March 6,1989.

This inspection disclosed apparent weaknesses in certain areas of your physical security program. The NRC was particularly concerned about various failures on NPPD's part to either log or report security incidents that appeared to meet NRC's criteria for logging and reporting. Because this issue closely paralleled the findings of an NRC investigation (Report of Investigation 4-85-016, the synopsis of which was provided to NPPD in a letter dated December 15,1985), the May 11 enforcement ca.1ference was conducted to discuss both the more recent inspection findings and the investigative conclusion that the former NPPD Administrative Services Manager had in 1985 purposefully prevented security incident reports from being filed and available to NRC inspectors.

Based on our review of NPPD's investigation of the 1989 inspection findings, our review of the report you submitted on April 14, 1989, and our discussions of these matters during the enforcement conference, the NRC has concluded that while the violations may be similar, it does not appear that the root cause is the same.

It appears that the February 1989 violations resulted from a weak system for determining the deportability of events, inadequate training, and poor implemen-tation of the system that was in place. Therefore, we are issuing the enclosed Notice of Violation (Notice) for the violations of NRC requirements disclosed by the February 1989 inspection. We will correspond separately on our decision regarding the findings of the Office of Investigations in Report 4-85-016.

Nebraska Public Power District-2-You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response.

In your response, you should document the specific actions taken and any additional actions you plan to prevent recurrence. After reviewing your response to this Notice, including your proposed corrective actions and the results of future inspections, the NRC will determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.

In~accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and its enclosure will be placed in the NRC Public Document Room.

The responses directed by this letter and the accompanying Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
